Norma Fundamental contribui para compreender o fundamento l\u00f3gico que sustenta decis\u00f5es jur\u00eddicas contempor\u00e2neas, estabelecendo v\u00ednculo com a cr\u00edtica hermen\u00eautica do direito na centralidade atribu\u00edda \u00e0 linguagem como pressuposto fundamental de interpreta\u00e7\u00e3o.<\/span><\/p><ul><li><span style=\"font-family: arial, helvetica, sans-serif;font-size: 10pt\"><b>Resumo da pesquisa:\u00a0<\/b><\/span><\/li><\/ul><p><span style=\"font-family: arial, helvetica, sans-serif;font-size: 10pt\"><span style=\"font-weight: 400\">Esta pesquisa investiga a possibilidade de uma interpreta\u00e7\u00e3o simb\u00f3lica e ontol\u00f3gica da Norma Fundamental, partindo da m\u00e1xima do direito romano:<\/span><i><span style=\"font-weight: 400\"> ubi societas, ibi jus<\/span><\/i><span style=\"font-weight: 400\">, como f\u00f3rmula de neutralidade, ainda dentro dos limites metodol\u00f3gicos do positivismo relativista kelseniano. A norma \u00e9 concebida como s\u00edmbolo jur\u00eddico fundador, cuja fun\u00e7\u00e3o emerge como fen\u00f4meno coletivo estruturado pela linguagem, permitindo uma leitura que parte da normatividade de Hans Kelsen e dialoga com a hermen\u00eautica de Gadamer e Heidegger. Integrando essas perspectivas, a Norma Fundamental pode ser compreendida como um s\u00edmbolo jur\u00eddico fundador que se revela na fus\u00e3o de horizontes e na exist\u00eancia social.<\/span><\/span><\/p><ul><li><span style=\"font-family: arial, helvetica, sans-serif;font-size: 10pt\"><b>Quem deveria conhecer os resultados da pesquisa?<\/b><\/span><\/li><\/ul><p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif;font-size: 10pt\">Os resultados da pesquisa impactam debates sobre validade, legitimidade e limites da interpreta\u00e7\u00e3o jur\u00eddica, especialmente no constitucionalismo.
